Wake Data Collection Consent & Release Agreement
Last updated: October 26, 2026
This is the agreement a contributor signs in the Wake app before their first recording, alongside the Contributor Agreement. How biometric data derived from recordings is kept and destroyed is set out in the Biometric Data Retention and Destruction Policy.
Before You Start Recording
By tapping "I Agree & Start Recording", you agree to the terms below. Please read them - they're written to be clear, not buried.
1. What You're Consenting To
You are voluntarily recording video footage using the Wake app ("Recording"). Your Recording may capture:
- Physical environments, objects, and surfaces
- People present in the scene (including yourself)
- Motion, gestures, and physical interactions with objects
- Biometric data incidentally captured, such as facial geometry and body movements
2. Full Rights Assignment to Wake
You hereby irrevocably assign to Wake, Inc. ("Wake") all rights, title, and interest - including all intellectual property rights - in and to your Recording and any data derived from it, throughout the universe, in perpetuity.
This includes Wake's right to:
- Use, reproduce, modify, annotate, and process your Recording
- Use your Recording to train, test, and improve artificial intelligence and robotics systems
- License or sell datasets derived from your Recording to third parties (e.g., robotics companies, AI researchers)
- Store and archive your Recording indefinitely
You waive any right to inspect, approve, or receive compensation for any use of your Recording, except as required by applicable law.
3. What We Collect & How We Use It
- Video footage - Robot training dataset creation and AI model development
- Object and motion annotations - Labeling and structuring the dataset
- Biometric data (incidental) - Part of the dataset; may be de-identified or retained per applicable law
- Device metadata - Quality control and session integrity
- Precise device location, accuracy, and capture time - Recording provenance and dataset quality control
We do not sell your personal identity. Datasets are licensed for robotics and AI training purposes only.
4. Biometric Data Notice (Illinois, Texas & Other States)
If you are located in Illinois, Texas, or another state with biometric privacy laws:
- Wake may collect biometric identifiers (including facial geometry) as part of your Recording.
- Your Recording will be retained for the duration of Wake's business operations or as required by law, then securely destroyed.
- Wake will not sell or disclose your biometric data to third parties except as permitted by applicable law.
- By agreeing, you provide informed written consent to this collection as required under the Illinois Biometric Information Privacy Act (BIPA) and the Texas Capture or Use of Biometric Identifier (CUBI) Act.
5. People & Property in Your Recording
You represent and warrant that:
- You have obtained verbal or written consent from any identifiable individuals who appear in your Recording.
- You have the right to record in the location where the Recording takes place (you own, lease, or have permission to record on the property).
- Your Recording does not violate any third-party privacy rights, NDAs, or applicable laws.
You release Wake from any claims by third parties arising from people or locations appearing in your Recording.
6. Your Representations
By agreeing, you confirm that:
- You are at least 18 years old (or the age of majority in your jurisdiction).
- You are recording voluntarily and are not being coerced.
- The content of your Recording does not depict illegal activity.
- You have the authority to enter into this agreement.
7. Privacy
Your personal information (name, email, account data) is handled per Wake's Privacy Policy. Your Recording is associated with your account for quality control purposes. You may request deletion of your personal data by contacting privacy@wake.inc - note that anonymized or aggregated dataset contributions cannot be individually reversed once processed.
8. Governing Law
This agreement is governed by the laws of the State of Delaware, without regard to conflict of law principles. Disputes will be resolved by binding arbitration (JAMS rules), individually - no class actions.
This is a legally binding agreement. Questions? Contact legal@wake.inc before recording.
