# Do I pay taxes on Upwork gig income? A US contractor guide

Yes. In the United States, income from freelance work on Upwork is generally taxable, including side income. Not receiving a 1099 does not make the income tax-free. The [IRS gig economy guidance](https://www.irs.gov/businesses/gig-economy-tax-center) makes that distinction clear.

This guide covers US federal rules for independent contractors, checked in October 2026. State and local rules can differ. For advice about your own return, use a qualified tax professional.

## A 1099 reports payments, not your final tax bill

Upwork explains that freelancers may receive Form 1099-K when reporting conditions apply. It issues 1099-NEC only in limited circumstances; employees paid through Upwork Payroll receive a W-2. See [Upwork's US income-reporting guidance](https://support.upwork.com/hc/en-us/articles/211063958-Report-income-as-a-U-S-freelancer-on-Upwork).

A form's reporting threshold is different from your obligation to report taxable income. Do not wait for a form before keeping records.

## Understand income, expenses and profit

For a sole proprietor, Schedule C generally reports business income and deductible business expenses. Schedule SE is used to calculate self-employment tax when required. The [IRS self-employed tax center](https://www.irs.gov/businesses/small-businesses-self-employed/self-employed-individuals-tax-center) explains both.

Keep these records together:

| Record | Why it matters |
| --- | --- |
| Client payments and platform statements | Track business receipts |
| Platform fees and refunds | Reconcile gross receipts with deposits |
| Receipts for business expenses | Support eligible deductions |
| Tax forms received | Check reported amounts against your records |
| Estimated payments already made | Avoid overlooking tax you have paid |

A phone, internet plan or camera used personally and for work is not automatically a fully deductible business purchase. Ask how the business-use portion and applicable deduction rules apply.

The [IRS advises using a 1099-K alongside other records](https://www.irs.gov/businesses/understanding-your-form-1099-k) to determine taxable income. Avoid counting the same payment twice when it appears in multiple records.

## Two thresholds people confuse

**$400:** net earnings from self-employment of $400 or more generally trigger self-employment tax. This is not a blanket income-tax exemption below $400. Other filing rules can still apply. [IRS self-employment tax guidance](https://www.irs.gov/taxtopics/tc554).

**$1,000:** estimated tax payments are generally required if you expect to owe at least $1,000 after withholding and refundable credits, and your withholding and credits fall below the applicable IRS safe-harbor amount. Exceptions apply. Use the [IRS estimated-tax guidance](https://www.irs.gov/faqs/estimated-tax/individuals) or Form 1040-ES to calculate your position.

There is no single correct percentage for everyone to set aside.

## Questions, answered.

What if Upwork does not send me a tax form?

You still need to report taxable freelance income. Use your own records and platform statements.

Does this also apply to paid video tasks?

US tax obligations depend on your status and income, not whether the gig involves typing or recording. Keep records of paid contributions too.

What if I live outside the US?

This article is not a guide to your local tax system. US citizens and some other US taxpayers abroad may also have US obligations. Check the rules that apply to you.
